Fiscal Employer Agents

There are two types of Fiscal/Employer Agents (FEAs) operating under section 3504 of the IRS Code. Government Fiscal/Employer Agents and Vendor Fiscal/Employer Agents serve as a type of “banking entity” allowing funds to be distributed in a self-directed manner by participants rather than agencies. According to leading experts, nearly 76% of all states reported utilizing one or more types agents.

Participants maintain control of their support services and individual budget funds while the FEA provides fiscal accountability for state programs and reduces much of the fiscal burden for participants and their representatives. Today, nationwide nearly 150 such organizations are reported to be in operation.

FEAs can provide a wide array of services that aid in the delivery and use of self-directed support services. But managing those programs and ensuring state program administrators, program participants, their representatives and home based workers that they are in compliance with federal, state and local employment tax, and related rules can be a big challenge.
